Probate may have different meanings depending on context in which it is being used. It could refer to the process of presenting a will to court for filing purposes. On the other side, it could refer to a process of administering and processing an estate using correct legal procedures, after the death of the estate owner. Family probate is very important in ensuring that property is distributed in an orderly manner.

Nowadays, estate left behind by the dead person, is usually probated whether there is a will or not. However, with a will that is valid, the probation process becomes simple and straightforward. This is because the property owner has clearly outlined best ways in which his or her properties should be shared. Will also states the people who should receive a share of the property.

In case there is absence of a will, or the available one does not cover everything, there is law that helps in ensuring that there is fairness in property distribution. The law has been applied successfully in City of Dallas, TX for quite some time. The law is important because it helps determine the correct beneficiaries. Sharing ratio is also defined too.

It is true that law differs between different states. This means that the way to go about probation process may also differ slightly between different states. However, it is important to note that entire process has a lot of similarities within the state. Swearing by the personal representative is normally done after they are appointed by the court.

However, a court may decide a personal representative, if the owner of the property did not leave a will. A court may also choose a representative, if will present does not state a person who should act as a representative. Court can also assume the role, if the person stated in will is either dead, or cannot serve owing to various issues. Any of family members may request a court to appoint him or her as a representative. If one is allowed he or she is issued a document called letters testamentary by the court.

Representative appointed by court or that stated within will left by the deceased, has the duty of informing public that the owner of a certain estate is dead. This is usually accomplished by publishing death notice on local media. This will not only be of importance to creditors, but also to other individuals who may be interested with the estate. Those interested are then allowed to follow the acceptable procedure when applying to receive a share of property within the required time.

Inventorying stage is important because payment of debts and also distribution of property to the beneficiaries are done in right manner. The process is also important in ensuring that all the assets available are accounted for. In case of a missing property, right procedure is followed with intention of acquiring it back.

Next stage involves distribution of property of estate. It is important to note that, distribution of property to beneficiaries is done after creditors have been settled. If the entire process is conducted as required personal representative is usually protected by the law from any issues that may arise in future.
