With A Bail Bondsman La Habra Accused May Be Released

By Matthew Stone

Most people are not even fully aware of all the many laws and regulations that rule their daily lives. The complexity of modern society makes in necessary to introduce numerous laws to make sure that law and order prevail. Transgressors are arrested and charged and tried by a court of law. Sadly, the courts are swamped with a backlog of cases and new cases are routinely delayed for months. But with help from a bail bondsman La Habra accused can go free.

Thousands of arrests are made each year and many of those arrested are normally law abiding citizens that made stupid mistakes. Being arrested is a stressful experience and the prospect of being found guilty of committing a crime is a daunting one indeed. That is why anyone accused of committing a crime should immediately appoint an experienced criminal defense attorney to deal with the matter.

While the majority of arrested individuals are allowed to go free until they have to appear in court, this is not a right. The court will decide whether the accused is likely to attend his case, whether he poses a danger to himself or others and whether he is likely to interfere in the investigation. If the court is not sure, or if the accused have a previous criminal record, then he may be kept incarcerated.

The courts try to make sure that those they release will honor the conditions of that release. To this end they require the accused to post a specified amount as surety. Once the case is heard, the money is refunded. If the accused does not have the money available, he can approach bondsmen for help. These are money lenders that specialize in providing fast loans to accused individuals.

Bondsmen are only too aware of the fact that their clients are desperate to be released. By offering a fast and efficient service, they often finalize an application and pay the surety within an hour or so. For this service they charge between ten and fifteen percent of the total loan amount. In some cases this can be a very hefty fee. The client also has to sign an agreement.

Unfortunately, most people borrowing from bondsmen do not study the terms and conditions before they sign. At the time, all they wanted was to get the issue behind them It is only later that they realize that these terms are restricting to the extreme. The slightest infringement can lead to the loss of the assets pledged as surety. It is much better to rather let the lawyer handle it.

Breaching the conditions of being released will almost certainly turn out to be a massive mistake with serious consequences. The offender will be arrested once again and he will be charged with additional criminal offences. He will lose the money paid as surety and the court may not be so lenient to allow a second release. If they do, the accused will have to take out a second loan from the bondsmen.

The system is not perfect but there are not really any alternatives. People cannot be detained for months on end without being tried. Until a court finds someone guilty, he must be treated as innocent. This is a constitutional right.
